Married? - Need a Will
If you are a married person in Scotland and you die without making a will (referred to as intestate) the estate is divided as follows:
- The deceased spouse will inherit the estate’s first £312,00, the deceased spouse will also inherit plenishings(furniture and other household moveable goods) of up to £24,000, in addition to a further £24,000.
- If anything remains it will be inherited by the deceased's parents and brothers and sisters
- If the deceased has no parents/siblings if will be inherited by the spouse
- If no spouse, it will be inherited by the aunts and uncles
- In none of the above, it will be inherited by Grandparents, or their siblings.
- If no blood relatives can be traced, the Crown will inherit the balance.
